“ALL Heartists" is a loyalty program of Accor SA (" Accor "), a public limited company, entered in the Nanterre Trade & Companies Register with the no. 602 036 444, whose registered office is located at 82 rue Henri Farman - 92130 Issy-les-Moulineaux - 92130 Issy-les-Moulineaux.
The ALL Heartists program is operated by a subsidiary of Accor, mandated by the latter, the company Service Concierge, a joint stock company registered in the Paris Trade & Companies Register with the no. 485 281 232, whose registered office is located at 64-66, rue des Archives - 75003 PARIS.
Service Concierge is a company which intervenes mainly as an intermediary in the relations between private individuals and suppliers of products or service providers.l
“ALL Heartists" also means the Accor and Service Concierge entities.
The ALL Heartists program is a program under which you have access to benefits from reputable partners (the "ALL Heartists program").
As an employee and associates of Accor, including its subsidiaries and branches around the world, you benefit from the ALL Heartists program.
The ALL Heartists program is governed by these terms and conditions of use (hereinafter referred to as the "Terms and Conditions" or “T&Cs”).
It is here recalled that the ALL Heartists program is offered to persons of full age who have the capacity to contract and accept the Conditions.
You can benefit from the ALL Heartists program by creating an account on the website allheartists.com (hereinafter referred to as the "Website"); when you create your account, you are asked to accept the Terms and Conditions.
Any registration on the Site, any order/reservation of services placed on the Site shall constitute your acceptance, without restriction or reservation, of the T&Cs.
I. – Presentation of the ALL Heartists program
The ALL Heartists program offers you the opportunity to order, at preferential rates, services or the supply of goods, via the Site, from suppliers of goods or service providers (hereinafter referred to as "Partners").
ALL Heartists acts only as an intermediary between you and the Partners, who actually deliver the services or goods ordered via the Site.
The ALL Heartists program offers discounts on services related to everyday life, travel, wellness and sport, culture and leisure, gourmet food and shopping.
II. - MODALITIES OF THE WELCOME PROGRAM
Membership in the ALL Heartists program:
To benefit from the ALL Heartists program, you can contact your human resources department to apply for membership.
This person will then confirm that your application for membership has been taken into account, and will remind you that this membership entails the processing of your personal data by ALL Heartists, in accordance with the Privacy Policy.
Within a period of up to [6] weeks, you will receive your ALL Heartists card and the address of the Site, on which you must register in order to benefit from the offers and advantages of ALL Heartists Partners.
Your ALL Heartists card is valid for two years; upon expiry of the ALL Heartists, and if you are still an employee or associates of the Accor Hotels group, you must renew your application for ALL Heartists membership. Failing this, your membership will be terminated in accordance with point VI. Liability - Termination.
Registration on the Website:
To register with ALL Heartists program all you have to do is complete the number on the back of your ALL Heartists card (i.e. your username), your first and last name, an email address, and password on the registration form of the Website. Your password is strictly confidential to you, and you are required to keep it confidential.
To validate your registration, you are asked to accept the T&Cs, the processing of your personal data, and you can opt to receive ALL Heartists newsletters.
Access to the ALL Heartists program is strictly personal, and you are not allowed to transmit your login data to any third party. If you do not respect this obligation, ALL Heartists reserves the right to suspend your ALL Heartists membership.
Once you have registered on the Website, you have access to a list of offers of goods or services offered by Partners at advantageous rates; (i) promotional codes or discount coupons may be downloaded from the Website to benefit directly from the Partners' websites or in physical stores, as stated in the terms and conditions of the offers and benefits, or (ii) you will be redirected directly to the Partners' websites, from the Website.
No request for reservation of a service offered by one of the ALL Heartists Partners formulated outside the Website will be taken into account.
The offers available on the Website are subject to the terms and conditions of the Partners and have a limited validity period. ALL Heartists recommends that you read the terms and conditions of the Partners' offers, and particularly the cancellation terms if applicable.
III. – Payment
The payment of Partners’services is directly made at Partners in accordance with their terms and conditions.
ALL Heartists is not involved in payment terms / customer journey of Partners.
IV. CLAIM - RIGHT OF WITHDRAWAL - REFUND
Claim :
If you are dissatisfied or encounter a problem with a Partner's offer or advantage, you may lodge a complaint with ALL Heartists, by calling +331 76 64 79 95 or by completing the form provided for this purpose on the Website. ALL Heartists will only consider claims thus submitted.
Right of withdrawal - Refund:
To exercise your right of withdrawal, for each order, you only need to follow what is indicated in the general conditions of the Partners.

IV. CLAIM - RIGHT OF WITHDRAWAL - REFUND

Right of withdrawal - Refund:
To exercise your right of withdrawal, for each order, you only need to follow what is indicated in the general conditions of the Partners.

In accordance with European Directive 2011/83/E on consumer right, you have fourteen days to exercise your right of withdrawal.
When your request concerns the delivery of a non-perishable good or merchandise not manufactured to measure, the period of fourteen days runs from the reception of the said good or merchandise, in other cases, the period runs from the validation of the order.
In accordance with the provisions of with European Directive 2011/83/E on consumer rights, you do not have a right of withdrawal in the following cases:
When your request concerns the delivery of a non-perishable good or merchandise not manufactured to measure, the period of fourteen days runs from the reception of the said good or merchandise, in other cases, the period runs from the validation of the order.
In accordance with the provisions of with European Directive 2011/83/E on consumer rights, you do not have a right of withdrawal in the following cases:
Delivery of perishable products (foodstuffs, flower bouquets, ...),
Delivery of services that have been fully performed before the end of the withdrawal period, and whose execution began as soon as the order was confirmed after you have expressly waived your right of withdrawal,
Delivery of goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection,
Delivery of goods or services whose price depends on market fluctuations,
Delivery of alcoholic beverages whose delivery is delayed beyond 30 days and whose value agreed upon at the conclusion of the contract depends on fluctuations in the market beyond the control of the trader,
Accommodation services, other than residential accommodation, transportation of goods, car rentals, catering or recreational activities that must be provided on a specified date or at a specified period (show seats, etc.).
Delivery of services that have been fully performed before the end of the withdrawal period, and whose execution began as soon as the order was confirmed after you have expressly waived your right of withdrawal,
Delivery of goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection,
Delivery of goods or services whose price depends on market fluctuations,
Delivery of alcoholic beverages whose delivery is delayed beyond 30 days and whose value agreed upon at the conclusion of the contract depends on fluctuations in the market beyond the control of the trader,

Non-residents of the European Union
In accordance with Regulation (EC) No 593/2008 of 17 June 2008 on the law applicable to contractual obligations (Rome I), you have the right of withdrawal as defined in the law of the country of which you are resident.
ALL Heartists does not intervene in any way in the exercise of your right of withdrawal, which must be made directly to the Partner concerned, in accordance with the legal provisions mentioned above.
ALL Heartists is only an intermediary between you and the Partners, therefore ALL Heartists will not make any reimbursement whatsoever. Any request for reimbursement must be made directly to the Partners.
When an order is cancelled by a Partner for reasons for which it is responsible (case of force majeure, unavailability of stocks,...), this Partner is responsible for the reimbursement of the ordered service, in accordance with the provisions of the consumer law duly applicable; in general the reimbursement is carried out according to the same means of payment as that used for the order.
It is also usual that in the event of payment, in whole or in part, by gift vouchers or promotional codes, these cannot be refunded either in cash, by cheque (if applicable in your residence country), or by bank transfer. Refunds of purchases made by gift vouchers or promotional codes, or at least of the portion made by gift vouchers or promotional codes, shall be made exclusively in the form of gift vouchers or promotional codes for an amount identical to that paid in this form.
V. - Website Management
For the proper management of the Website, ALL Heartists reserves the right to suspend, interrupt or limit access to all or part of the Website for any reason whatsoever, particularly for maintenance or updating purposes or in the event of an attack on the Website.
Any creation of a hypertext link to the Site or any part of the Website is prohibited without the prior written consent of ALL Heartists. Hypertext links to the Website may have been created without the knowledge of ALL Heartists. In this case, ALL Heartists cannot be held responsible for the information presented on these sites.
The existence of a hypertext link on the Website referring to another site (for example, a partner's site) does not imply a validation of this site or its content by ALL Heartists. In this respect, the Website and the partner sites remain strictly independent.
VI. – Liability – Termination
The delivery of services is the sole responsibility of the Partners.
The termination of your membership in the ALL Heartists Program, for any reason whatsoever, does not result in the cancellation of orders you have placed with the Partners, and does not prevent you from using the promotional codes or coupons already downloaded from the Website.
Partners are required to provide you with offers and benefits; in the event of a problem, do not hesitate to contact ALL Heartists (see point IV. - Complaint - Right of withdrawal - Refund).
Use of the Website:
Use of the Website is at your own risk. Thus, ALL Heartists cannot be held liable for any malicious program that could infect your computer equipment or any other hardware or software, nor for any loss or alteration of data resulting from the use of the Website.
It is your responsibility to take all appropriate measures to protect your data, computer systems or software from contamination by viruses, Trojan horses or, more generally, any computer programs that may compromise the security of the Website.
Subject to the applicable legal and/or regulatory provisions, ALL Heartists cannot be held liable for any direct or indirect damage related to the use or inability to use the Website and more generally, for any event related to the Website such as technical failures, breakdowns, interruptions, modifications of the Website, ...
ALL Heartists does not guarantee the availability, accuracy, completeness, reliability or timeliness of the information available on the Website.
You are also reminded that you remain solely responsible for the data that you share with ALL Heartists. ALL Heartists cannot be held liable for any errors, omissions or inaccuracies in the information thus submitted. You are solely responsible for the use of your password.
VII. – Intellectual Property
All visuals, trademarks, logos, logos, any other distinctive signs, photos, texts, all elements present on the Website, the Website itself, and on newsletters are the exclusive property of ALL Heartists, the Partners, or third parties who have authorized ALL Heartists to use said elements (hereinafter the "Content").
The Content, in whole or in part, may be protected by copyright, trademark, patent or other intellectual property rights.
The information (including the Content) published on the Website may never be used for commercial or advertising purposes.
Subject to the provisions of Article L342-3 of the Intellectual Property Code or of any duly applicable regulation, ALL Heartists prohibits the extraction, reuse, commercialization, distribution, modification, adaptation, translation, transcription, arrangement, compilation, de-compilation, assembly, disassembly, transcoding, reverse engineering of the Application, as well as the reproduction of all or part of Content without its express prior written permission. Failure to comply with this prohibition constitutes an infringement liable to engage your civil and criminal liability.
VIII.- Law in force and competent jurisdiction
These Terms and Conditions shall be governed by French law, and any dispute arising therefrom shall be subject to the jurisdiction of your residence country.
ALL Heartists does not intervene in any way in the exercise of your right of withdrawal, which must be made directly to the Partner concerned, in accordance with the legal provisions mentioned above.
ALL Heartists is only an intermediary between you and the Partners, therefore ALL Heartists will not make any reimbursement whatsoever. Any request for reimbursement must be made directly to the Partners.
When an order is cancelled by a Partner for reasons for which it is responsible (case of force majeure, unavailability of stocks,...), this Partner is responsible for the reimbursement of the ordered service, in accordance with the provisions of the consumer law duly applicable; in general the reimbursement is carried out according to the same means of payment as that used for the order.
It is also usual that in the event of payment, in whole or in part, by gift vouchers or promotional codes, these cannot be refunded either in cash, by cheque (if applicable in your residence country), or by bank transfer. Refunds of purchases made by gift vouchers or promotional codes, or at least of the portion made by gift vouchers or promotional codes, shall be made exclusively in the form of gift vouchers or promotional codes for an amount identical to that paid in this form.
